WELCOME to EasyWorkweek, a service of Tinyplaces Hong Kong Limited.

This User Agreement ("Agreement") is a contract between you and EasyWorkweek and applies to your use of EasyWorkweek services and any related products and services available through www.easyworkweek.com (collectively the "Service"). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.

You must read, agree with, and accept all of the terms and conditions contained in this Agreement and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of EasyWorkweek. We strongly recommend that, as you read this Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as an EasyWorkweek user.

Tinyplaces Hong Kong Limited provides this service to you, subject to the following Terms of Use ("TOU") that may be updated by us from time to time without notice to you. In addition to this, you shall be subject to the operating rules / policies applicable to the membership plans on EasyWorkweek.com which may be posted from time to time. Tinyplaces Hong Kong Limited may also offer other services / plans on this website or different services on its other websites that are governed by different Terms of Service AS MAY BE APPLICABLE.

EasyWorkweek ("EasyWorkweek", "we", or "us") provides this web site, easyworkweek.com (the "Site"), to provide information, recommendations and on-location and remote concierge services (the "Services"). The term personal concierge is used to indicate anything that needs to be handled with physical presence. The term virtual assistant is used to indicate anything that can be handled through the Internet, phone, email or fax.
The terms, conditions and guidelines associated with use of the Services, the Site and any content (collectively, the "Content") available on the Site are set forth in this Terms of Use ("TOU"). Please read this TOU carefully before you use the Services or the Site. By using the Services or the Site you (“user”, "you" or "your," as appropriate) agree to abide by the terms, conditions, and guidelines set forth in this TOU.

Both EasyWorkweek and the user acknowledge and agree that the Services performed by EasyWorkweek, its employees, agents or sub-contractors shall be as an independent contractor and that nothing in this Agreement shall be deemed to constitute a partnership, joint venture, agency relationship or otherwise between the parties.

Except as is provided in the EasyWorkweek privacy policy, EasyWorkweek may update or change this TOU from time to time without notice. Such changes will be effective on the date that such modified TOU is posted on the Site, which is located at http://www.easyworkweek.com/tou.html. USE OF THE SITE OR SERVICES AFTER SUCH CHANGES HAVE TAKEN EFFECT CONSTITUTES ACCEPTANCE OF ALL CHANGES.

Please also note that if EasyWorkweek determines at any time that you have abused or violated any of these terms, conditions and guidelines, EasyWorkweek reserves the right to terminate your access to the Site and Services immediately without notice.

Concierge Recommendations and Information:

The concierges' comments and recommendations presented on the Site or through email or on phone or through fax, are based on research and opinions collected by the concierges and/or our support personnel, and are indicative and subject to change at any time.

User Name, PIN and Security:

You are responsible for maintaining the confidentiality of your user name and PIN, and you are solely responsible for all activities that occur under your user name and PIN. You agree to immediately notify EasyWorkweek of any unauthorized use of your user name and PIN or any other breach of security related to the Site. EasyWorkweek WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO ADEQUATELY SAFEGUARD YOUR USERNAME AND/OR PIN OR TO OTHERWISE COMPLY WITH THIS SECTION.

Eligibility:

The Services and the Site are available only to individuals or entities who can form legally binding contracts under applicable law and who are employees and affiliates of entities that have entered into a services agreement with EasyWorkweek or one of its distributors. Without limiting the foregoing, the Services and the Site are not available to individuals under the age of eighteen (18). If you do not qualify, you may neither use the Services nor the Site.

Subscription and Service Terms:

  1. To use EasyWorkweek personal concierge and virtual assistant services, users must be subscribed to an EasyWorkweek subscription plan or be committed to a service agreement and by doing so, user agrees to pay the relevant fees and charges as and when they become due. The period during which you are subscribed to an EasyWorkweek subscription plan or contracted EasyWorkweek services will be referred to as the “subscription period” hereforth.

  2. We reserve the right to suspend/terminate all and any services rendered to the user whether fully or partially completed and withhold all and any materials and intellectual property created thereof as our own should you not fulfil your obligations to pay the relevant fees and charges when they become due.

  3. User agrees to pay for any purchases and/or shipping charges you authorize during your subscription period.

  4. You will also be charged any out-of-pocket expenses incurred (transportation, long distance calls, etc.) while your tasks are carried out. We use Skype for International Calls unless specifically instructed otherwise.

  5. We reserve the right to decline tasks which we feel that we cannot handle comfortably or in an excellent manner.

  6. Hours included in subscription plans are not transferable, not convertible to cash and cannot be exchanged for cash.

  7. You can upgrade or downgrade between any two plans with a previous month advance notice period in writing to your Support Leader.

  8. All plans require a previous month notice period for termination. This means that if you inform us of the termination this month, your last month of subscription will be the next.

  9. All our EASY plans come with Rollover Time:

    a. Unused time from what is allotted for the plan in a month (“Rollover Time”) gets rolled over to the next month automatically subject to a maximum of a total of 20% of your monthly plan.

    b. Once your accumulated Rollover Time exceeds that amount, the excess is lost indefinitely.

    c. If you change from one EASY plan to another EASY plan, any accumulated Rollover Time in excess of the new plan’s allotted maximum rollover time will be forfeited upon such change.

    d. If you change to STARTER or a BASIC plan, then all Rollover Time is lost indefinitely.

    e. In the event of cancellation, your Rollover Time, if any, is lost indefinitely.

    f. Rollover Time is not redeemable for cash or credit and is not transferable.

Privacy:

EasyWorkweek knows how important privacy is to you and is committed to honouring your privacy. You can review EasyWorkweek's privacy policy, which is incorporated by reference into this TOU, at http://www.easyworkweek.com/privacy.html

In order to ensure that EasyWorkweek is able to provide high quality services that have response to customer needs, EasyWorkweek employees may need to access your accounts, card information on a regular basis and pertinent records on a case-by-case basis to investigate complaints or other allegations or abuses. EasyWorkweek shall not disclose the existence or occurrence of such an investigation unless required by law.

Links to third party sites:

Some of the links on the Site may allow you to leave EasyWorkweek.com Site. Third-party sites to which the Site may link ("Third-Party Linked Sites") are not in any way under EasyWorkweek’s control, and EasyWorkweek DOES NOT ASSUME ANY RESPONSIBILITY OR LIABILITY FOR ANY INFORMATION, CONTENT, COMMUNICATIONS, SERVICES, GOODS OR OTHER MATERIALS AVAILABLE ON SUCH THIRD-PARTY LINKED SITES OR FOR ANY CHANGES OR UPDATES TO SUCH SITES. EasyWorkweek does not intend links contained on the Site to be referrals to, or endorsements of, any Third-Party Linked Site or the entities that operate them, and such links are provided for convenience only.

General Disclaimer:

The site, including all third party linked sites and all services, content and materials provided in the site, are provided to you on an "as is, with all faults" basis, and your use of such sites, services, content and materials is at your own risk. EasyWorkweek disclaims all warranties whether expressed or implied including, without limitation, to the warranty of merchantability, fitness for particular purpose, title, infringement, and quiet enjoyment.

Limitation of Liability:

In no event will EasyWorkweek and/or any of its partners, providers, affiliates, including their respective officers, directors, employees or representatives, be liable for any indirect, incidental, special, consequential, reliance, compensatory, or punitive damages or damages resulting from lost profits, lost data or business interruption arising out of the use, inability to use, or the results of use of the site or EasyWorkweek services. EasyWorkweek services, its services available on the site, any websites linked to the site, the materials or information contained at the site or the foregoing limitations of liability constitute a fundamental basis of this TOU and EasyWorkweek would not have permitted you to use the site or EasyWorkweek services absent of such limitations.

Prohibited Uses:

As a user of the Services or the Site, you agree to use the Services and the Site only for lawful purposes. Use of the Services or the Site for transmission, distribution, retrieval or storage of any information, data, or other material in violation of any applicable law or regulation is prohibited. You also agree not to use the Services or the Site to:

1. Use or transmit any material protected by copyright, trademark, trade secret, patent, or other intellectual property right without proper authorization;

2. Harass others by "mail-bombing" or "news-bombing";

3. Threaten, harass, defame, embarrass or distress any person or group;

4. Distribute computer viruses, worms, or any software/s intended to damage or alter a computer system without the owner's consent;

5. Use "auto-responders," "cancel-bots," or other similar mechanisms that generate excessive network traffic;

6. Post or send any unlawful, harmful, defamatory, slanderous, pornographic, obscene, vulgar or similarly tortuous or otherwise objectionable material;

7. Post, send or relay any unsolicited advertising;

8. Post or send any chain letters or pyramid schemes;

9. Post or send any fraudulent or misleading offers of products, items, loans, or other services;

10. Post any misleading, inaccurate or fraudulent information;

11. Post any junk e-mails;

12. Post any duplicative or unsolicited messages;

13. Harvest or otherwise collect information about others, including e-mail addresses, without their specific consent;

14. Create a false identity or forged e-mail address or header or otherwise attempt to mislead others as to the identity of the sender or the origin of the message; or

15. Attempt to gain unauthorized access to the Services, other accounts, computer systems or networks connected to the Site through any means.

Termination:

EasyWorkweek, in its sole discretion may terminate the Services and access to this Site at any time without prior notice to you. In the event of termination, the Links to Third-Party Sites, General Disclaimer, Limitation of Liability, Prohibited Uses, Proprietary Rights, Indemnity, Applicable Laws and General Terms Sections set forth in this TOU shall still survive. Users who violate this TOU may additionally incur criminal and/or civil liability. EasyWorkweek may refer violators to civil or criminal authorities for prosecution, and will cooperate fully with applicable government authorities in connection with its investigations of any suspected civil or criminal violations.

Proprietary Rights:

Software: You acknowledge and agree that the Service and any software used in connection with the Service ("Software") contain proprietary rights and confidential information that is protected by applicable intellectual property and other associated laws. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the web interface or via email or telephone / fax access numbers that may be provided by EasyWorkweek for use in accessing the Service.


Intellectual Property: EasyWorkweek agrees to grant to the user a non-exclusive, irrevocable, royalty free license to use, copy and modify any elements of the Material not specifically created for the user as part of the Services. In respect of the Material specifically created for the user as part of the Services, we assign the full title guarantee to the user and any all of the copyright, other intellectual property rights and any other data or material used or subsisting in the Material whether finished or unfinished. If any third party intellectual property rights are used in the Material we shall ensure that it has secured all necessary consents and approvals to use such third party intellectual property rights for us and the user. For the purposes of this Clause, "Material" shall mean the materials, in whatever form, used by us to provide the Services and the products, systems, programs or processes, in whatever form, produced by us pursuant to this Agreement.


Warranty:

We represent and warrant that:

  1. We will perform the Services with reasonable care and skill; and
  2. The Services and the Materials provided by EasyWorkweek to the user under this Agreement will not infringe or violate any intellectual property rights or other right of any third party.

Indemnity:

You agree to indemnify, defend at your expense and hold harmless EasyWorkweek, its telecommunications providers and service providers and its subsidiaries, affiliates, officers, directors, employees, consultants and agents (if any), from all and any third-party claims, liability, damages and costs (including, but not limited to, attorneys' fees) arising from or relating to (i) your use of the Services and/or the Site, (ii) any content you post, e-mail, transmit or relay either to EasyWorkweek or by use of the Services or the Site, (iii) your violation of the TOU, or (iv) your alleged infringement of any intellectual property or other right of any person or entity.

Information Storage:

You are responsible for storing and maintaining all and any relevant intellectual property, data, and information arising from your service requests to EasyWorkweek once the service requested has been rendered and accepted. EasyWorkweek will destroy and delete all related information, including the backup copies, and any exported copies both physical and electronic after the services are completed and accepted by you. 

Item Storage:

Items that arise from your service requests to EasyWorkweek will only be held and kept by EasyWorkweek, if undeliverable or not collected, for a maximum period of 7 days from the first day EasyWorkweek possesses it. After 7 days, EasyWorkweek reserves the right to own, use, dispose, sell, and rent the item.

Notice:

All notices to a party shall be in writing and shall be made either via e-mail or fax or mail. Notice shall be deemed given 24 hours after an e-mail that is not returned to the sender is sent, or 3 days after deposit in the Hong Kong Post, to you at the address provided by you upon registration and to EasyWorkweek at the address set forth below:

Changes to Site and Services:

EasyWorkweek reserves its right to change, suspend or discontinue any aspect of the Services in part or in whole at any time, including the availability of any of the Site features, promotions, prices, delivery services, databases or its Content thereof. EasyWorkweek may also impose limits on features or restrict access to all or certain parts of the Site.

We provide offers and promotions which may vary from time to time. Users are advised to check our Site or contact our service staff for current offers.

Applicable Laws:

You agree and submit yourself to the jurisdictional statutes and laws of the Hong Kong SAR, without regard to the conflicts of law principles, will govern all matters relating to this TOU or to your use of the Site. EasyWorkweek makes no representation that materials on the Site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal or prohibited. Those who choose to access the Site shall be doing so on their own initiative and shall be solely responsible for compliance with their local laws.

This TOU is entered into on a person-to-person basis and is non-transferable, and you may not assign your rights or obligations to any third party on your behalf.

General Terms:

If any provision(s) of the TOU is found to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

EasyWorkweek's failure to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. The TOU constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the TOU will be effective only if unambiguously made in writing and signed by EasyWorkweek.

CANCELLATION AND REFUND POLICY

1. On completion of your registration, you become a member and charges for usage in that month will be charged immediately the pro-rated amount of the monthly subscription, where applicable. Packaged usage hours, where applicable, will be pro-rated accordingly as well.

2. From the subsequent month, charges will be made in advance to your credit card before the 5th of every month towards that month’s membership fees. If you decide to opt out / cancel your membership at any point of time after you become a member, it will require a termination notice of a minimum of 30 days for cancellation. The termination notice works this way: If you inform us of your account termination anytime within the month, the last day of your subscription will be the last day of next month. Your last invoice will be sent to you on the 1st of the following month. Such cancellation request should be emailed to support@easyworkweek.com, the Support Personnel assigned to you or fax to +852 2214-8724 (Hong Kong SAR). If you cancel your membership without providing advance notice for termination, then you will be charged the membership fee for the notice period also.

3. No refunds on monthly membership fee will be possible for cancellation requests.

4. There will be additional charges for any services that are beyond the normal scope of the services agreed to. In such cases the customer will be informed of these additional charges. Once customer agrees to the additional charges the service will be performed and the same charges will be billed in the subsequent month's bill.

5. During the period of membership, any information provided / recommendations made / services rendered / purchases made, on instructions from you would be deemed to have been made on your behalf and hence shall make you responsible for all such transactions carried out by us on behalf of you. Discontinuation of service or termination of membership shall not absolve the user of responsibility for the transactions carried out by us on behalf of the user during the period of membership.

Privacy Policy

Your privacy is important to EasyWorkweek. Maintaining the trust of our users is key to the success of our business, and this Privacy Policy is intended to make you feel as comfortable as possible for visiting our website and using our services thereof.
This Privacy Policy discloses the privacy practices for the concierge services, web sites and any other sites and services operated by EasyWorkweek. This Privacy Policy will provide you with information on our policies regarding:

  1. What Personal Information is collected?
  2. Who collects the Personal Information?
  3. How the Personal Information is proposed to be used?
  4. The choices available to users regarding collection, use and distribution of the Personal Information?
  5. How you can update or correct any inaccuracies in the Personal Information?
  6. What kind of security procedures / precautionary measures we adopt to protect the loss, misuse, or alteration of your Personal Information under our control?

Personal Information:

"Personal Information" are information that would allow someone to identify or contact you, including, for example, your full name, address, telephone number, HKID or passport number or e-mail address. Personal Information does not include aggregated information that, by itself, does not permit the identification of individual persons (like statistics relating to the number of person visiting our web site for the previous week or month and alike).

Acceptance:

This Privacy Policy is a part of our Terms of User Agreement and by using the EasyWorkweek website and its services, you agree to be bound by its terms and conditions. This Privacy Policy only addresses activities from our servers. Other sites (including those that we link to and third party sites or services which we co-brand) may have their own policies, over which we have no control or authority, and thus are not addressed or controlled by this policy.

(1) What Personal Information is collected?

You provide certain Personal Information to us when you: (a) register to use the services, (b) complete questionnaires, (c) order products and services from us and (d) send e-mail messages, submit forms or send other information to us.

(2) Who Collects the Personal Information?

Tinyplaces Hong Kong Limited (TPHK), which owns and operates the EasyWorkweek web site and related sites, is the company that collects Personal Information. TPHK’s mailing address is Room 2104C, 21/F, Admiralty Centre Tower 1, 18 Harcourt Road, Admiralty, Hong Kong SAR and our customer service e-mail address is support@tinyplaces.com.

(3) How the Personal Information is proposed to be used?

We use your Personal Information to provide you with content and services that are tailored specifically to the profile you provide.

We do not sell or provide your Personal Information to third-party marketers or other third parties unless you expressly agree in advance to let us do so.

We use your information on an aggregated basis (not personally identifiable) to do such things as operate our site, enhance our site and sell and deliver messages. We may disclose aggregated information about our users but that information contains no Personal Information.

Although your privacy is very important to us, due to legal rules beyond our control, we cannot fully ensure that your private communications and other Personal Information will not be disclosed to third parties. For example, we may be forced to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, in the unlikely event we need to investigate or resolve possible problems or inquiries, we can, and you authorize us to, disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate. In addition, we may share Personal Information with our contractors on a need-to-know basis in order to maintain our services provided that such contractors have agreed to the non-disclosure and confidentiality requirements we require of our employees.

(4) The choices available to users regarding collection, use and distribution of personal information.

You can control the content of your Personal Information by following the instructions stated below in Section 6.

Please note that if you provide any information on your own or directly to parties who provide service to our web site or any other sites you encounter on the Internet (even if these sites are branded with our branding), different rules may apply to their use or disclosure of the Personal Information you disclose to them. We encourage you to investigate and ask questions before disclosing information to third parties.

(5) How users can update or correct any inaccuracies in the personal information

If Personal Information changes, or if you no longer desire our service, we will provide a way for you to correct, update or remove your Personal Information. This can usually be done by e-mailing your request to our customer support at support@easyworkweek.com.

(6) What kind of security procedures / precautionary measures we adopt to protect the loss, misuse, or alteration of your Personal Information under our control?

EasyWorkweek takes precautions to protect our users' information. When users submit sensitive information via e-mail, fax or other means, the same is protected both online and off-line. We use computer safeguards such as firewalls and data encryption, we enforce physical access controls to our offices and files, and we authorise access to personal information only to employees who need to know that information in order to fulfill their job responsibilities.

The security of your EasyWorkweek account also relies on your protection of your User Name and PIN. You may not share your User Name and/or PIN with anyone unless you expressly allow them to use your EasyWorkweek account. If you do share your EasyWorkweek User Name and/or PIN with a third party for any reason, including because the third party has promised to provide you additional services such as account aggregation, the third party will have access to your account and your personal information, and you may be responsible for actions taken using your User Name and/or PIN. If you believe someone else has obtained access to your User Name and/or PIN, please change it immediately by faxing the new set of User Name and PIN with your full name to +852 3184-8755.

We will notify you by e-mail of any significant changes and obtain your "opt-in" consent to any significant new uses of your Personal Information, if it was collected from you prior to a significant change in this policy. We may also make non-significant changes to our Privacy Policy that generally will not affect our use of your Personal Information.
